DANIEL WAYNE MAGDA
CTV Kitchener – July 17, 2012
The crown wrapped up its case today against 37-year-old Daniel Magda, who faces a number of charges related to sexual assault in connection with children.
For a third day, an 11-year-old boy took the witness stand.
Magda has admitted to sexually assaulting the boy, then 10 years old, as well as assaulting another boy who was three years old at the time.
However, the defense is arguing the crimes didn’t happen over an extended period of time.
Magda has pleaded guilty to seven charges, including producing child pornography, but not guilty to 10 other charges.
The 11-year-old testified that Magda was once like a father to him, though after the assault, the boy thought about killing Magda.
The boy also struggled when the defense suggested he wasn’t telling the truth about one incident, telling the court, “I know it’s the truth, because I felt it.”
On two occasions, he crossed his arms and stopped answering questions.
In 2007, Magda was convicted of assaulting three boys, but served less than a year of his two year sentence.
The mother of one of Magda’s previous victims was in court and says she understands how tough it has been for the 11-year-old to testify.
“He just wants it to be over,” Debbie Farrow says. “He doesn’t want to talk about it. It’s something very bad that happened to him and he doesn’t want to talk about it anymore. I think he just wants to put it behind him and thank God he’ll be able to, I hope.”
Magda’s trial resumes in September.
The defence has not yet said whether it will call evidence at that time.
